Saudi MHRSD Approves New Labor Inspection Regulations for Violations

RIYADH: Saudi Ministry of Human Resources and Social Development (MHRSD) has approved new executive regulations governing labor inspections, allowing repeated visits to workplaces with a high rate of Labor Law violations.

Under the regulations, companies found in serious violation will receive an electronic warning and must correct the issue within three working days. 

If no action is taken, a violation report will be issued, and penalties will be applied based on the ministry’s violation schedule.

Employers are required to respond via the ministry’s official email within three days of notification. Failure to do so will result in legal action. 

Inspectors are also authorized to examine machines, installations, and safety measures to ensure compliance with occupational health standards.

Inspectors must be Saudi nationals who have completed college or have at least two years of relevant work experience in order to be eligible. 

They must undergo proper training and pledge confidentiality regarding workplace information.

Inspectors cannot be reassigned or given unrelated duties without approval from the deputy minister or a designated official. 

They must carry official accreditation during inspections and return it when leaving the role.

Workplace visits may occur during any working hours, with or without the employer present. Prior notice is generally required unless urgent intervention is necessary. 

Inspectors may access all work-related records and documents to verify legal compliance.

The regulations emphasize the protection of both employer and worker rights, ensuring that penalties are imposed only after due process. 

Employers and employees are entitled to defend themselves before any administrative actions are finalized.
